Terms of Service

1. Scope of Photography Services

The Company provides commercial, headshot, event, and editorial photography services. Pre-event consultations occur no later than three (3) days prior to the session date to review image shot lists, floor plans, and schedules.

• Multi-Location Travel: Travel between multiple session locations is billed as part of the overall session time.
• Image Selection & Editing: All images are subject to professional review. The Company reserves the right to withhold raw or unedited files or any images that do not meet our quality standards.
• Online Gallery Delivery: Edited digital images are delivered via a secure online gallery link within approximately seven (7) business days and remain accessible for ninety (90) days following the session.

2. Payments, Fees & Late Solicitations

A non-refundable retainer fee is required upon execution of a service agreement to reserve the project date. Remaining balances are due within thirty (30) days following the photography session.

• Payment Methods: Credit cards, cash, money orders, cashier’s checks, and checks made payable to Connie Hobbs Photography LLC are accepted. Returned checks incur a $35 fee.
• Late Solicitations: Services requested less than sixty (60) days before the event require a 50% upfront payment. Services requested less than thirty (30) days before require 100% payment upon agreement execution.
• Additional Expenses: The Client is responsible for travel expenses, venue access fees, permits, parking, and passes incurred by the Company.

3. Cancellation, Rescheduling & Weather Policy

Retainer fees compensate the Company for reserving dates and declining other bookings and are non-refundable.

• Client Cancellations: Cancellations made more than 30 days prior to the session incur no fee beyond the retainer. Cancellations within 30 days require 50% of the remaining balance. Cancellations within 14 days require 100% of the remaining balance.
• Rescheduling: The Company will make reasonable efforts to accommodate one rescheduled date requested within 12 months, subject to availability.
• Weather Conditions: Sessions operate rain or shine; however, the Company reserves the right to suspend or cancel services due to unsafe conditions (lightning, flooding, severe storms). In such events, fees paid beyond the retainer will be refunded if rescheduling is impossible.

4. Work Product Ownership & Commercial License

All photographs, digital files, edits, and copyrightable works remain the sole and exclusive property of Connie Hobbs Photography LLC.

• Commercial License: Upon full payment, Client is granted a perpetual, non-exclusive, non-transferable license to use delivered images for business, marketing, PR, website, social media, and advertising purposes.
• Third-Party Vendors: Client’s employees, developers, PR firms, and marketing agencies may use the images solely on behalf of the Client. Images may not be sold, sublicensed, or distributed for third-party commercial gain without prior written consent.
• Image Alterations: Client may crop or resize images for publication. Client may not substantially alter, apply filters to, or manipulate images in a way that misrepresents the Company’s work.
• Portfolio Promotion: The Company reserves the right to display images in its portfolio, website, marketing materials, and exhibitions unless restricted by a signed confidentiality agreement.

5. Confidentiality & Safety Conduct

Both parties agree to protect and safeguard confidential business details, trade secrets, and proprietary information disclosed during the engagement. The Company reserves the right to unilaterally rescind agreements or deny service if client or attendee conduct violates safety standards or applicable laws.

6. Limitation of Liability & Disclaimers

The maximum aggregate liability of the Company, its affiliates, and business partners for any claims arising out of services provided shall be limited strictly to the total amount paid by the Client to the Company.

In no event shall the Company be liable for incidental, consequential, indirect, or punitive damages, lost profits, or limitations caused by third-party media or attendees present during events. Implied warranties beyond express contractual commitments are expressly disclaimed.

7. Governing Law & Dispute Resolution

These Terms and all service agreements are governed by the internal laws of the Commonwealth of Pennsylvania without regard to conflict of law principles. Any controversy or claim arising from these Terms shall be resolved by binding commercial arbitration administered by the American Arbitration Association (AAA) in Dauphin County, Pennsylvania.
